ICE Is in My Neighborhood. What Are My Rights?

ICE Is in My Neighborhood. What Are My Rights?

In 2026, immigration enforcement operations have increased significantly across the country. Communities that had not seen this level of activity in years are now seeing it regularly. And many people — regardless of their immigration status — do not know what their rights are when ICE agents are in the area, at the door, or making an arrest nearby. Knowing your rights before something happens is the most important preparation you can do. Here is the information every member of an immigrant community should have.

And many people — regardless of their immigration status — do not know what their rights are when ICE agents are in the area, at the door, or making an arrest nearby. Knowing your rights before something happens is the most important preparation you can do. Here is the information every member of an immigrant community should have.

These Rights Apply to Everyone — Regardless of Status

The constitutional protections that limit how law enforcement can interact with individuals apply to everyone in the United States — citizens, visa holders, permanent residents, and undocumented individuals alike. Immigration status does not determine whether you have constitutional rights. You have them. The question is knowing how to use them.

If ICE Comes to Your Door

You do not have to open the door.

If ICE agents knock on your door, you are not required to open it unless they present a judicial warrant — a warrant signed by a judge, not an administrative warrant signed by an immigration officer. Ask them to slide the warrant under the door or hold it up to a window so you can read it. An administrative warrant, also called a warrant of removal or deportation warrant, does not give officers the legal authority to enter your home without your consent.

You do not have to answer questions.

You have the right to remain silent. You do not have to answer questions about your immigration status, where you were born, how you entered the country, or anything else. You can say clearly through the door: I do not consent to this search. I am exercising my right to remain silent. Please speak with my attorney.

Do not lie.

While you have the right to remain silent, lying to a federal officer is a separate offense that can significantly complicate your case. Saying nothing is always safer than saying something false.

If You Are Stopped Outside

If an ICE agent stops you in a public place, you have the right to ask whether you are free to go. If the officer says yes, walk away calmly. If the officer says no, you are being detained. At that point, clearly state that you are exercising your right to remain silent and that you want to speak with an attorney before answering any questions.

Do not physically resist or argue. Comply with the physical directions of the officer while asserting your legal rights verbally and clearly. Physical resistance creates a separate set of legal problems that are very difficult to undo.

If Someone in Your Family Is Detained

Try to get the officer's name and badge number if possible. Write down everything you remember about what happened — time, location, what was said, what was shown. Contact an immigration attorney as quickly as possible. In removal cases, the first 24 to 48 hours matter enormously because bond hearings and emergency motions to stay removal have strict timeframes.

You have the right to contact your country's consulate. If the detained person is not a U.S. citizen, they have the right to be informed of this and to have consular officers notified of their detention if they choose.

What You Can Do to Prepare Now

Do not wait for something to happen before you prepare. Every member of a household that could be affected by immigration enforcement should carry a know-your-rights card. Every family should have a safety plan — who to call, where important documents are, who can take care of children if a parent is detained. Every person with a pending immigration case should have their attorney's contact information somewhere accessible outside their phone.

Sharing this information with your community is one of the most practical things you can do right now. These rights protect everyone. The more people know them, the more effective they are.
