This program, known as “Family Reunification,” aimed to benefit those individuals who entered the country without proper documentation and have been residing in the United States for at least 10 years.

However, the optimism surrounding this initiative has been met with legal challenges as 16 states, predominantly led by Republicans, filed a lawsuit asserting that the program is unconstitutional. As a result of this legal action, a federal judge has temporarily halted the implementation of the Biden administration’s policy, pausing it until September 23rd, 2024.

During this period, the U.S. Citizenship and Immigration Services (USCIS) can still accept applications but is unable to approve or deny them. Also, USCIS is still scheduling of biometric appointments and collect biometrics at Application Support Centers (ASCs).

Despite this setback, eligible applicants are encouraged to submit their applications without fear of repercussions. Attorney Soulmaz Taghavi advises that if individuals qualify for Biden’s parole in place, they should proceed with their applications. Soulmaz further emphasizes the importance of taking action now, stating that historically, when the government grants a benefit, it becomes challenging to revoke it later.
