Cancellation is relief an immigration judge may grant to certain people in removal proceedings. Separate rules apply to permanent residents, nonpermanent residents and some abuse survivors.
Eligibility
Regular nonpermanent resident cancellation generally requires 10 years of continuous physical presence, good moral character, no disqualifying convictions and exceptional and extremely unusual hardship to a qualifying relative. Other bars and judicial discretion apply.

Continuous Physical Presence in the U.S.
Regular nonpermanent resident cancellation generally requires 10 years of continuous physical presence. Stop-time rules, departures and exceptions affect how time is counted.
Good Moral Character
Regular nonpermanent resident cancellation requires good moral character for the legally required period, as well as meeting separate criminal and other eligibility rules.
Criminal and Other Eligibility Bars
Certain convictions and statutory bars can prevent eligibility. Entry without inspection or a visa overstay alone does not automatically rule out cancellation; your full history needs review.
Family or Hardship Factor
For regular nonpermanent resident cancellation, removal must cause exceptional and extremely unusual hardship to a U.S. citizen or lawful permanent resident spouse, parent or child.
Ability to Prove Hardship
Evidence must be provided to show that the hardship to the qualifying relative is beyond the typical hardship caused by separation or relocation.
Different Rules for Permanent Residents
Green card holders have different rules: generally five years as a permanent resident, seven years of residence after admission in any status, and no aggravated felony conviction. Stop-time rules and other bars apply.
