EB5 Visa Requirements:
Investment Amount
The investor must invest at least $1 million in a new U.S. commercial enterprise, or $500,000 if the investment is in a targeted employment area (high-unemployment or rural area).
Creation of Jobs
The investment must create or preserve at least 10 full-time jobs for U.S. workers within two years of the investment.
At Risk Investment
The investment must be at risk, meaning the investor could lose part or all of their capital in the business venture. Passive investments are not eligible for the EB5 Visa.
New Commercial Enterprise
The investment must be in a new commercial enterprise, which is either a newly established business or a business that has been restructured or expanded to meet the EB5 criteria.
Source of Investment Funds
The investor must prove the legal source of the funds used for the investment, such as income, loans, or other personal assets. This includes providing detailed documentation.
U.S. Business and Regional Center Eligibility
The investment can be made directly into a business or through a USCIS-approved regional center, which facilitates investments in certain projects that meet EB5 requirements.
